Recommendation CM/Rec(2010)5 of the Committee of Ministers to member states on measures to combat discrimination on grounds of sexual orientation or gender identity
Recommendation CM/Rec(2010)5 of the Committee of Ministers to member states on measures to combat discrimination on grounds of sexual orientation or gender identity was adopted on 31 March 2010.[1] Its explanatory memorandum, was prepared by the CDDH.
The Recommendation enhances the full enjoyment of all human rights by lesbian, gay, bisexual and transgender persons. The main message of the Recommendation is that discrimination and social exclusion on account of sexual orientation or gender identity may best be overcome by measures targeted both at those who experience such discrimination or exclusion, and the population at large. The text of the Recommendation is the first instrument drawn up by the Committee of Ministers dealing specifically with the question of discrimination based on sexual orientation and gender identity.
Three years after its adoption, the CDDH, at its 77th meeting (19-22March2013) adopted its report on the implementation of the Recommendation (CDDH(2013)R77AddVI) and transmitted it to the Committee of Ministers. At the 1189th Deputies’ meeting (22 January 2014, item 4.1), it was agreed that the issue of the implementation of the provisions of the recommendation would be reconsidered in four years’ time. On that basis, the CDDH adopted the second report on the implementation of the Recommendation (CDDH(2019)R92Addendum4) and transmitted it to the Committee of Ministers.
In the terms of reference of the CDADI for the years 2022-2025 (CM(2021)131-addfinal), the Committee of Ministers tasked the CDADI to review each year thematic dimensions of Recommendation CM/Rec(2010)5 and to carry out a comprehensive review of the implementation of this recommendation based on a new review methodology by the end of 2025.
Accordingly, the CDADI working group on sexual orientation, gender identity, gender expression and sex characteristics (GT-ADI-SOGI) elaborated a new methodology for the present implementation review which was adopted by the CDADI at its 6th meeting (29 November-1 December 2022, CDADI(2022)22).
On the basis of the replies to the questionnaire, the ADI-SOGIESC and the Secretariat will prepare a report which will be submitted for adoption to the CDADI at its 11th meeting (first semester of 2025).
To facilitate member States’ replies, the new questionnaire has been drawn up on the basis of the 2018 and 2012 versions, following strictly the structure of the Recommendation itself and prefilled to ensure that baseline information is collated in respect of all member States. Member States are invited to validate, update, modify or complete the prefilled information. Information already communicated in reply to the 2012 and 2018 questionnaire may be found in the CDDH report CDDH(2019)R92Addendum4 adopted in November 2019, available here and in the CDDH report CDDH(2013)R77 adopted in March 2013, available here.
It is understood that the Recommendation CM/Rec(2010)5 covers discrimination on the grounds of sexual orientation or gender identity. In the previous review, several member States also reported on measures related to intersex individuals. The ADI-SOGIESC, as mandated by the Committee of Ministers, is currently working on a new draft Recommendation on the equality of rights for intersex persons. In light of these ongoing developments, this questionnaire extends an invitation to member States interested in doing so to share any additional measures or updates concerning this matter, where available. Such contributions can facilitate the drafting of the Recommendation on the equality of rights for intersex persons.
The competent authorities are kindly invited to submit the information requested by 31 July 2024 close of business.
Препорука Комитета министара Савета Европе CM/Rec (2010)5 у вези са мерама усмереним на борбу против дискриминације на основу сексуалне оријентације или родног идентитета
Препорука КМ/Рез(2010)5 Комитета министара државама чланицама у вези са мерама усмереним на борбу против дискриминације на основу сексуалне оријентације или родног идентитета усвојена је 31. марта 2010. године. Њен меморандум је припремио Управни комитет за људска права Савета Европе (CDDH).
Препорука унапређује пуно уживање свих људских права од стране лезбејки, хомосексуалаца, бисексуалних и трансродних особа. Главна порука Препоруке је да се дискриминација и социјална искљученост на основу сексуалне оријентације или родног идентитета најбоље могу превазићи мерама усмереним како на оне који доживљавају такву дискриминацију или искљученост, тако и на становништво у целини. Текст Препоруке је први инструмент који је саставио Комитет министара који се посебно бави питањем дискриминације на основу сексуалне оријентације и родног идентитета.
Три године након усвајања, CDDH је на 77. састанку (19-22. марта 2013.) усвојио свој извештај о имплементацији Препоруке (CDDH(2013)R77AddVI) и прослиедио га Комитету министара. На 1189. седници народних посланика (22.01.2014, тачка 4.1) договорено је да се питање спровођења одредаба препоруке поново размотри за четири године. На основу тога, CDDH је усвојио други извештај о имплементацији Препоруке (CDDH(2019)R92addendun4) и проследио га Комитету министара.
У задатку Управног одбора за борбу против дискриминације, различитости и инклузије (CDADI) za period 2022-2025 (CM(2021)131-addfinal), Комитет министара је задужио ЦДАДИ да сваке године преиспита тематске димензије Препоруке ЦМ/Рец(2010)5 и да изврши свеобухватан преглед спровођења ове препоруке на основу нове методологије прегледа до краја 2025. године.
Сходно томе, радна група CDADI за сексуалну оријентацију, родни идентитет, родно изражавање и полне карактеристике (GT-ADI-SOGI) разрадила је нову методологију за садашњи преглед имплементације коју је CDADI усвојио на свом 6. састанку (29. новембар- 1. децембар 2022, CDADI (2022)22).
На основу одговора на упитник, АADI-SOGIESC и Секретаријат ће припремити извештај који ће бити поднет на усвајање CDADIна 11. састанку (прва половина 2025. године).
Да би се олакшали одговори држава чланица, нови упитник је састављен на основу верзија из 2018. и 2012. године, стриктно пратећи структуру саме Препоруке и унапред попуњен како би се осигурало да се основне информације упореде у односу на све државе чланице. Државе чланице су позване да потврде, ажурирају, модификују или допуне унапред попуњене информације. Информације које су већ саопштене као одговор на упитник за 2012. и 2018. могу се наћи у CDDH извештају CDDH (2019)R92addendun4 усвојеном у новембру 2019, доступном овде и у извештају CDDH(2013)R77 усвојеном у марту 2013 https://rm.coe.int/168045fdfb
Позивају се надлежни органи да доставе информације до 31. јула 2024. године.
