Recommendation CM/Rec(2010)5 of the Committee of Ministers to member states on measures to combat discrimination on grounds of sexual orientation or gender identity

Recommendation CM/Rec(2010)5 of the Committee of Ministers to member states on measures to combat discrimination on grounds of sexual orientation or gender identity was adopted on 31 March 2010.[1] Its explanatory memorandum, was prepared by the CDDH.

The Recommendation enhances the full enjoyment of all human rights by lesbian, gay, bisexual and transgender persons. The main message of the Recommendation is that discrimination and social exclusion on account of sexual orientation or gender identity may best be overcome by measures targeted both at those who experience such discrimination or exclusion, and the population at large. The text of the Recommendation is the first instrument drawn up by the Committee of Ministers dealing specifically with the question of discrimination based on sexual orientation and gender identity.

Three years after its adoption, the CDDH, at its 77th meeting (19-22March2013) adopted its report on the implementation of the Recommendation (CDDH(2013)R77AddVI) and transmitted it to the Committee of Ministers. At the 1189th Deputies’ meeting (22 January 2014, item 4.1), it was agreed that the issue of the implementation of the provisions of the recommendation would be reconsidered in four years’ time. On that basis, the CDDH adopted the second report on the implementation of the Recommendation (CDDH(2019)R92Addendum4) and transmitted it to the Committee of Ministers.

In the terms of reference of the CDADI for the years 2022-2025 (CM(2021)131-addfinal), the Committee of Ministers tasked the CDADI to review each year thematic dimensions of Recommendation CM/Rec(2010)5 and to carry out a comprehensive review of the implementation of this recommendation based on a new review methodology by the end of 2025.

Accordingly, the CDADI working group on sexual orientation, gender identity, gender expression and sex characteristics (GT-ADI-SOGI) elaborated a new methodology for the present implementation review which was adopted by the CDADI at its 6th meeting (29 November-1 December 2022, CDADI(2022)22).

On the basis of the replies to the questionnaire, the ADI-SOGIESC and the Secretariat will prepare a report which will be submitted for adoption to the CDADI at its 11th meeting (first semester of 2025).

To facilitate member States’ replies, the new questionnaire has been drawn up on the basis of the 2018 and 2012 versions, following strictly the structure of the Recommendation itself and prefilled to ensure that baseline information is collated in respect of all member States. Member States are invited to validate, update, modify or complete the prefilled information. Information already communicated in reply to the 2012 and 2018 questionnaire may be found in the CDDH report CDDH(2019)R92Addendum4 adopted in November 2019, available here and in the CDDH report CDDH(2013)R77 adopted in March 2013, available here.

It is understood that the Recommendation CM/Rec(2010)5 covers discrimination on the grounds of sexual orientation or gender identity. In the previous review, several member States also reported on measures related to intersex individuals. The ADI-SOGIESC, as mandated by the Committee of Ministers, is currently working on a new draft Recommendation on the equality of rights for intersex persons. In light of these ongoing developments, this questionnaire extends an invitation to member States interested in doing so to share any additional measures or updates concerning this matter, where available. Such contributions can facilitate the drafting of the Recommendation on the equality of rights for intersex persons.

The competent authorities are kindly invited to submit the information requested by 31 July 2024 close of business.

Preporuka KM/Rez(2010)5 Komiteta ministara državama članicama u vezi sa merama usmerenim na borbu protiv diskriminacije na osnovu seksualne orijentacije ili rodnog identiteta usvojena je 31. marta 2010. godine. Njen memorandum je pripremio Upravni komitet za ljudska prava Saveta Evrope (CDDH).

Preporuka unapređuje puno uživanje svih ljudskih prava od strane lezbejki, homoseksualaca, biseksualnih i transrodnih osoba. Glavna poruka Preporuke je da se diskriminacija i socijalna isključenost na osnovu seksualne orijentacije ili rodnog identiteta najbolje mogu prevazići merama usmerenim kako na one koji doživljavaju takvu diskriminaciju ili isključenost, tako i na stanovništvo u celini. Tekst Preporuke je prvi instrument koji je sastavio Komitet ministara koji se posebno bavi pitanjem diskriminacije na osnovu seksualne orijentacije i rodnog identiteta.

Tri godine nakon usvajanja, CDDH je na 77. sastanku (19-22. marta 2013.) usvojio svoj izveštaj o implementaciji Preporuke (CDDH(2013)R77AddVI) i prosliedio ga Komitetu ministara. Na 1189. sednici narodnih poslanika (22.01.2014, tačka 4.1) dogovoreno je da se pitanje sprovođenja odredaba preporuke ponovo razmotri za četiri godine. Na osnovu toga, CDDH je usvojio drugi izveštaj o implementaciji Preporuke (CDDH(2019)R92addendun4) i prosledio ga Komitetu ministara.

U zadatku Upravnog odbora za borbu protiv diskriminacije, različitosti i inkluzije (CDADI) za period 2022-2025 (CM(2021)131-addfinal), Komitet ministara je zadužio CDADI da svake godine preispita tematske dimenzije Preporuke CM/Rec(2010)5 i da izvrši sveobuhvatan pregled sprovođenja ove preporuke na osnovu nove metodologije pregleda do kraja 2025. godine.

Shodno tome, radna grupa CDADI za seksualnu orijentaciju, rodni identitet, rodno izražavanje i polne karakteristike (GT-ADI-SOGI) razradila je novu metodologiju za sadašnji pregled implementacije koju je CDADI usvojio na svom 6. sastanku (29. novembar- 1. decembar 2022, CDADI (2022)22).

Na osnovu odgovora na upitnik, AADI-SOGIESC i Sekretarijat će pripremiti izveštaj koji će biti podnet na usvajanje CDADIna 11. sastanku (prva polovina 2025. godine).

Da bi se olakšali odgovori država članica, novi upitnik je sastavljen na osnovu verzija iz 2018. i 2012. godine, striktno prateći strukturu same Preporuke i unapred popunjen kako bi se osiguralo da se osnovne informacije uporede u odnosu na sve države članice. Države članice su pozvane da potvrde, ažuriraju, modifikuju ili dopune unapred popunjene informacije. Pozivaju se nadležni organi da dostave informacije do 31. jula 2024. godine.
